We have long experience of advising clients on constitutional issues. Specialist advice in this area is given to charities and political party advisors as well as national regulatory bodies, both statutory and non-statutory.
Today, there is an ever-increasing awareness of the ability to question decisions of various bodies on public law grounds by way of judicial review or before specialist tribunals, and we have extensive experience of advising not only those who seek to challenge decisions in this way but also those bodies whose actions might be thus challenged.
An important aspect of this work is an awareness of the duties of public bodies under the Human Rights Act 1998 and our appreciation of the ways in which the courts will, or will not interpret legislation to be compliant with the European Convention on Human Rights.
